Terms of Service
Note for English Speakers The official version of these Terms is in Japanese. Please use your browser's translation feature to read them. In case of any conflict between the Japanese version and a translation, the Japanese version will prevail.
These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions of use for the web application "Cyclayer" (hereinafter referred to as "the Service") provided by Y.Kuroki, the Cyclayer operator (hereinafter referred to as "the Operator"). All users (hereinafter referred to as "Users") are required to use the Service in accordance with these Terms.
Article 1 (Service Description and Beta Status)
- The Service provides functionality to overlay and display information based on locally imported ride data (FIT files, etc.) onto cycling videos owned by Users.
- The Service is currently provided as a "Beta version" under development. Users acknowledge in advance that the Service may contain unexpected defects, bugs, and system errors.
- The Operator makes no warranties regarding the completeness, accuracy, or usefulness of the Service.
Article 2 (Authentication and Risk of Data Loss)
- The Service (Beta version) uses "anonymous authentication (guest login)" functionality that does not require registration of personal information such as email addresses.
- Users' account information and settings data are linked to their browser (Cookies/LocalStorage, etc.). Users acknowledge that performing any of the following actions will result in permanent and irreversible data loss:
- Clearing browser cache and cookies
- Ending a private/incognito browsing session
- Accessing from a different browser or device
- The Operator bears no responsibility for any damages caused to Users by data loss.
Article 3 (Data Processing and Storage)
- Video Data Processing: All video compositing in the Service is performed on the User's device (browser) (client-side processing). Video files are never transmitted to or stored on the Operator's servers.
- Ride Data Processing: All ride data (FIT files, etc.) analysis is performed on the User's device (browser) (client-side processing). Ride data is never transmitted to or stored on the Operator's servers.
- Information Stored on Servers: The following information is stored on servers. For details on the handling of each type of information, please refer to the Privacy Policy.
- Authentication information (anonymous user identifier issued by Firebase Auth)
- Usage data (video metadata, in-app settings, statistical data, etc.)
- Content voluntarily submitted by Users through the inquiry/feedback form
Article 4 (Usage Environment and Disclaimer)
- As the Service performs resource-intensive video editing processes in the browser, it is highly dependent on the specifications of the User's device.
- The Operator does not guarantee operation on all devices. The Operator bears no responsibility for delays caused by insufficient device specifications, browser crashes, data loss, or similar issues.
- Users are solely responsible for handling rights (copyright, portrait rights, etc.) when publishing videos created using the Service on the internet (social media, video sharing sites, etc.). The Operator has no involvement in any disputes with third parties arising from the publication of created videos.
Article 5 (Use by Minors)
Minors must obtain consent from their parents or legal guardians before using the Service.
Article 6 (Prohibited Activities)
Users shall not engage in any of the following activities when using the Service:
- Placing excessive load on the Service's servers (such as sending a large number of API requests in a short period)
- Reverse engineering, decompiling, or analyzing the Service's programs
- Activities that violate laws or public order and morals
- Activities that may interfere with the operation of the Service
- Any other activities deemed inappropriate by the Operator
Article 7 (Changes, Suspension, and Termination of Service)
The Operator may change, add to, suspend, or terminate all or part of the Service without prior notice to Users. The Operator bears no responsibility for any damages caused to Users as a result.
Article 8 (Ownership of Rights)
- Copyright of videos (deliverables) created using the Service belongs to the User.
- Rights to the original videos and ride data used by Users belong to the Users or their rightful owners. However, as the Service does not have sharing functionality, User data is stored only under the management of the respective User.
- Intellectual property rights related to the Service's programs, design, etc. belong to the Operator.
Article 9 (Handling of Feedback)
Feedback such as opinions, comments, and improvement suggestions submitted by Users through the Service's contact form may be freely used by the Operator at no cost for improving and developing the Service.
Article 10 (Changes to Terms of Service)
The Operator may change these Terms at any time without notice to Users when deemed necessary. The revised Terms shall take effect from the time they are posted on this website.
Article 11 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with Japanese law. In the event of any dispute arising in connection with the Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
Article 12 (Governing Language)
These Terms are executed in the Japanese language. In the event of any conflict or inconsistency between the Japanese version and any translation thereof, the Japanese version shall prevail and take precedence.
